These documents are provided by My POD Care Inc (doing business as "Care-N-Care"). They govern your use of our website, apps, and services that enable calendar-based coordination of care (such as childcare, pet care, and similar services).

Member Terms of Use

Also sometimes called "Terms of Service" or "Member Agreement".

1. Acceptance of These Terms

These Member Terms of Use (“Terms”) are a binding agreement between you and My POD Care Inc (“Care-N-Care,” “we,” “us,” or “our”). By accessing or using the Care-N-Care website, mobile application, or any other services we provide (collectively, the “Service”), you agree to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of the Service

Care-N-Care is a neighborhood-focused platform that allows members to:

  • Create and join private groups of neighbors, parents, and caregivers.
  • Coordinate calendars for care (such as childcare, pet care, and other similar care arrangements).
  • Communicate within groups via messages, posts, and media.
  • Share updates, including photos and other content, connected to care sessions.

The Platform does not supervise, monitor, or control in-person or virtual interactions or care arrangements made through the Platform.

We may add, change, or remove features from time to time, and we may suspend, discontinue, or restrict parts of the Service at our discretion.

3. Eligibility & Accounts

  • You must be at least 18 years old and capable of entering a legally binding contract to use the Service.
  • You agree to provide accurate, current, and complete information when you create an account and to keep it updated.
  • You agree to use your real identity and not impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • You are responsible for maintaining the security of your login credentials and for all activity under your account.

4. Platform Role & No Employment / Agency Relationship

Care-N-Care is a technology platform that enables users to connect and coordinate care. We do not:

  • Employ or supervise caregivers, parents, or sitters on the platform.
  • Provide care services ourselves.
  • Guarantee, endorse, or certify any user or care provider.

Any care arrangements, meetups, or services scheduled through the Service are solely between the users involved. You understand that you are responsible for evaluating and selecting the people you trust with your family, home, or pets, and for complying with any applicable laws (for example, background checks, licensing, or tax obligations).

5. User Content & License

You may post, upload, or otherwise submit text, photos, media, and other content through the Service (“User Content”). You retain any ownership rights you have in your User Content.

By submitting User Content, you grant Care-N-Care a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and improve the Service (for example, showing your messages and photos to members of your groups).

You are solely responsible for your User Content and you represent and warrant that you have all rights necessary to grant the license above, and that your content does not violate any law or third-party rights.

6. Prohibited Conduct

You agree that you will not, and will not assist or enable others to:

  • Use the Service for any unlawful, fraudulent, or malicious purpose.
  • Harass, threaten, or abuse other users, or post content that is hateful, discriminatory, or harmful.
  • Post content that incites violence, promotes illegal activity, or contains child sexual abuse material or exploitation.
  • Impersonate any person or entity, or misrepresent your identity or affiliation.
  • Attempt to scrape, crawl, or harvest data in bulk from the Service without our written permission.
  • Reverse engineer, decompile, or attempt to derive the source code of any part of the Service.
  • Interfere with or disrupt the operation of the Service or the experience of other users.

7. Parent Scheduling & Private Groups

Private Groups

Groups on the Platform are invitation-only and are created and managed by participating parents and guardians. The Platform:

  • Does not screen or vet group members beyond basic account verification
  • Does not verify identities beyond standard account registration
  • Does not endorse, approve, or recommend any group member

Membership decisions are made exclusively by the participating parents and guardians who manage each group.

No Background Checks for Group Members

The Platform does not conduct background investigations of parents or group members participating in scheduling groups. Any links to external public information sources are provided for informational convenience only. The Platform does not verify, interpret, or guarantee the accuracy of public records.

Assumption of Responsibility

Parents and guardians are solely responsible for:

  • Evaluating other group members before sharing care responsibilities
  • Supervising their children during all activities
  • Determining the suitability and safety of activities coordinated through the Platform
  • Ensuring safety in all in-person interactions

The Platform makes no representations regarding the character, background, fitness, or conduct of any user.

Community Scheduling & Cancellations

Care sessions, playdates, and other activities coordinated through the Platform are voluntary, mutual-aid arrangements between participating parents and guardians. They are not paid services, contractual commitments, or guaranteed appointments. The Platform facilitates scheduling and communication but does not guarantee that any scheduled session will occur as planned.

You acknowledge and agree that:

  • Any parent or guardian may cancel, reschedule, or decline a care session at any time and for any reason
  • Participation in community scheduling is entirely voluntary and does not create a binding obligation between users to provide care
  • The Platform is not responsible for cancellations, no-shows, late arrivals, early departures, or any changes to scheduled sessions by other users
  • You should not rely solely on a scheduled care session as your only plan for childcare, pet care, or other arrangements — always have a backup plan in case a session is canceled or modified
  • Disputes regarding scheduling, cancellations, or no-shows are between the users involved and must be resolved directly between those users — Care-N-Care will not mediate, arbitrate, or adjudicate scheduling disputes between community members

No monetary obligation: Community care scheduling through the Platform does not create a payment obligation between users. Users may not use the Platform to demand compensation, fees, or penalties from other users for canceled or rescheduled community care sessions.

Care-N-Care disclaims all liability for any loss, damage, inconvenience, or expense arising from a canceled, rescheduled, or unfulfilled care session, including but not limited to lost wages, missed work, backup childcare costs, travel expenses, or emotional distress.

8. Third-Party Services & Data Providers

The Platform integrates with, relies upon, or provides access to data and services from third-party providers, including but not limited to:

  • Mapping, location, weather, and navigation services (for group coordination, safety features, care session forecasts, and user-initiated directions to care locations)

Care-N-Care does not control, operate, or assume responsibility for any third-party service or data. The Platform's integration with or display of third-party data does not constitute endorsement, verification, approval, credentialing, or recommendation of any kind with respect to such third-party providers, their data, or their services.

You expressly relieve Care-N-Care from any and all liability arising from your use of or reliance on any third-party data, service, or content accessed through the Platform. Your interactions with third-party providers are solely between you and the third-party provider.

Third-party services are subject to their own terms, conditions, and privacy policies. Care-N-Care is not responsible for the privacy practices, security, accuracy, or availability of any third-party service.

9. Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, pose a risk to other users, or if it is reasonably necessary for us to protect our platform, users, or legal interests. You may stop using the Service and request account deletion at any time.

When you delete your account, all of your pending and future care sessions — including sessions you were scheduled to provide or receive — may be cancelled or become unavailable to other members of your care groups. Any reciprocal care obligations owed to or by you at the time of deletion are voided and are not enforceable through the Platform. You are solely responsible for notifying affected group members of your departure and for making alternative care arrangements before deleting your account. Care-N-Care is not responsible for any care disruption, lost reciprocal care, or scheduling impact caused by your or another user's account deletion.

10. Beta & Early Access Features

Care-N-Care may offer certain features, tools, or services that are designated as "beta," "early access," "preview," or similar ("Beta Features"). Beta Features are provided on an "as is" and "as available" basis and may contain bugs, errors, or other issues.

By using any Beta Feature, you acknowledge that:

  • Beta Features may be modified, suspended, or discontinued at any time without notice
  • Beta Features may not perform as expected or as described
  • Data entered into or generated by Beta Features may be lost or corrupted
  • Care-N-Care's total liability for all claims arising from your use of Beta Features shall not exceed one hundred U.S. dollars (US$100)

Care-N-Care is not obligated to provide support, maintenance, updates, or bug fixes for Beta Features.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee any particular outcome from your use of the Service.

12. Safety Information Disclaimer

Not a Safety Guarantee

Care-N-Care is a technology platform designed to help families coordinate care and access community resources. The Platform is not a safety service and does not guarantee the safety of any user, child, pet, household, or interaction.

Care-N-Care is a coordination platform that does not provide, source, or display third-party safety data, crime reports, or registry information.

Automatic Session Termination

To protect user privacy, the Platform automatically ends care sessions — including GPS location sharing — that remain active for more than 12 hours past their scheduled end time without manual confirmation from participants. When this occurs, affected users receive a push notification. This automatic termination is a safety safeguard and does not constitute an acknowledgment of completed care or a basis for dispute resolution. Users remain responsible for timely confirmation of care handoffs.

Not a Replacement for Emergency Services

The Platform is NOT A REPLACEMENT FOR EMERGENCY SERVICES. In the event of an emergency, always dial 911 immediately. Do not rely on the Platform to alert authorities, report incidents, or provide emergency assistance.

Not an Insurer

Care-N-Care is not an insurance provider and does not offer insurance coverage of any kind. The Platform's features — including group coordination tools and community resources — are not insurance benefits and are not a substitute for insurance coverage, personal judgment, or professional safety assessments.

Location Tracking Is a Best-Efforts Feature

Location sharing through the Platform is a supplementary scheduling convenience feature — it is not the primary purpose of Care-N-Care. Care-N-Care is a care coordination and scheduling platform; real-time location sharing is an optional enhancement available during active care sessions only.

Location tracking is provided on a best-efforts basis only. Care-N-Care makes no guarantee that location data will be available, accurate, continuous, or timely. Without limitation, location sharing may fail, be delayed, or be unavailable due to:

  • Device battery depletion or device shutdown
  • The user force-quitting the Care-N-Care app or the app being terminated by the operating system
  • Operating system restrictions on background location access, including Low Power Mode, background app refresh settings, or OS-level permission changes
  • Loss of GPS, cellular, or Wi-Fi signal (including tunnels, parking garages, basements, rural areas, or any area with limited connectivity)
  • Device placed in airplane mode or Do Not Disturb mode
  • The caregiver disabling location services through their device settings
  • Technical failures in third-party location infrastructure or services outside of Care-N-Care's control
  • Any other technical, environmental, or user-initiated condition affecting GPS availability

Care-N-Care shall not be liable for any harm, injury, damages, losses, or expenses of any kind arising from: (a) a failure, interruption, inaccuracy, or gap in location tracking; (b) any delay in location data; (c) the inability to locate a caregiver, child, or other person through the Platform; or (d) any reliance on location data displayed by the Platform, regardless of the reason for such failure or inaccuracy.

In any situation involving a genuine safety concern, do not rely on this Platform — call 911 immediately.

Assumption of Risk

To the extent permitted by applicable law, your access to and use of the Platform, including all safety-related features and information, is entirely at your own discretion and risk. You expressly acknowledge that:

  • No technology platform can guarantee the safety of real-world interactions
  • You are solely responsible for evaluating risks and making safety decisions for yourself and your family
  • Care-N-Care's provision of safety-related information does not create a duty of care, fiduciary relationship, or special relationship between you and the Platform

Dependent Care Notes & Medical Information

Care-N-Care provides two types of notes within the platform:

  • Care Block Notes — session-specific coordination notes entered by guardians about a particular care date (such as pickup instructions, reminders, or scheduling logistics).
  • Dependent Care Notes — health and medical information (including allergies, medical conditions, dietary restrictions, and care instructions) stored in a child's profile and accessible within a care block by tapping the child's name.

Dependent Care Notes are entered solely by parents and guardians and are not verified, validated, or monitored by Care-N-Care for accuracy, completeness, or currency. They do not constitute medical advice and are not a substitute for direct communication between guardians and care providers regarding a child's health, allergies, or medical needs. Care providers are solely responsible for tapping the child's name within each care block to review Dependent Care Notes, and for confirming critical medical information directly with the responsible guardian before and during each care session. In a medical emergency, call 911 immediately — do not rely solely on Dependent Care Notes.

Care-N-Care is not liable for any harm, injury, allergic reaction, or medical incident arising from inaccurate, incomplete, outdated, or unreviewed Dependent Care Notes.

13. Release of Liability

To the maximum extent permitted by applicable law, you release Care-N-Care and its officers, directors, employees, agents, and affiliates from any and all claims, demands, damages, losses, and causes of action arising out of or in any way connected with:

  • In-person or virtual interactions between users
  • Group activities or care arrangements coordinated through the Platform
  • The conduct, acts, or omissions of any user or third party
  • Cancellations, rescheduling, no-shows, or unfulfilled care sessions by any user, including any resulting lost wages, missed work, backup care costs, travel expenses, or other consequential damages
  • Account deletion by any user, including cancellation of pending care sessions, loss of reciprocal care obligations, or failure to receive care on a particular day as a result of another user deleting their account or losing access to the Platform
  • Pet-related incidents: Care-N-Care facilitates coordination of pet care visits but has no control over, responsibility for, or liability arising from the behavior of any animal, including but not limited to: bites, scratches, attacks, or injuries caused by a pet to a care provider, household members, children, bystanders, or any third party; property damage caused by a pet; injury or damage occurring at the pet owner's home, the care provider's home, or any other location; incidents occurring during pet walks or off-premises care; or the escape, loss, injury, or death of a pet in the care of a provider arranged through the Platform. The pet owner is solely responsible for their animal's behavior, containment, and wellbeing at all times, regardless of who is providing care and regardless of where the care takes place.

14. Limitation of Liability

To the fullest extent permitted by law, Care-N-Care and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

To the extent permitted by law, our total liability for all claims arising out of or related to the Service will not exceed one hundred U.S. dollars (US$100), or such greater amount as you have paid us in fees in the 12 months preceding the event giving rise to the claim.

Time Limitation on Claims

To the fullest extent permitted by applicable law, any claim or cause of action arising out of or related to your use of the Platform must be filed within one (1) year after the event giving rise to such claim or cause of action. Failure to file within this period shall result in the permanent barring of such claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Care-N-Care and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; or (c) your violation of these Terms or applicable law.

Parental Responsibility & Indemnification for Minors

If you are a parent or legal guardian registering a minor or permitting a minor to use any part of the Platform (including any features of the Platform), you agree to:

  • Exercise ongoing oversight of the minor's use of the Platform, including ensuring that such use is always in accordance with these Terms and all applicable laws
  • Accept the disclaimers, waivers, and limitations of liability set out in these Terms on your own behalf and on the minor's behalf
  • Be fully responsible and liable for the minor's compliance with these Terms and the minor's use of the Platform
  • Indemnify, defend, and hold harmless Care-N-Care and its officers, directors, employees, and agents from and against any and all claims, damages, losses, and expenses arising directly or indirectly from the minor's access to or use of the Platform

16. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to them will be governed by the laws of the State of Connecticut, without regard to its conflict of laws principles.

Informal Resolution. You and Care-N-Care agree to first attempt to resolve any dispute informally by contacting us at contact@care-n-care.com. We will try to resolve the dispute within 30 days.

Binding Arbitration. If informal resolution is unsuccessful, all disputes shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Fairfield County, Connecticut, except where arbitration is prohibited by applicable law.

Class Action Waiver. You and Care-N-Care agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found unenforceable, the entirety of this arbitration provision shall be null and void.

Exceptions. Either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims related to intellectual property or unauthorized access to the Service.

Right to Opt Out of Arbitration

You may opt out of the arbitration and class action waiver provisions of these Terms by sending written notice to contact@care-n-care.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, you and Care-N-Care agree that any disputes will be resolved exclusively in the state or federal courts located in Fairfield County, Connecticut.

Opting out of arbitration will not affect any other provisions of these Terms.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on the Platform and update the "Effective Date" at the top.

Changes will become effective no earlier than fourteen (14) days after they are posted, except that:

  • Changes addressing new features or functionality of the Platform may be effective immediately
  • Changes made for legal or regulatory reasons may be effective immediately

We may also notify you of material changes through the Platform, by email, or by other reasonable means. Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

18. Force Majeure

Care-N-Care shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or third-party service outages.

Privacy Policy

This Privacy Policy explains how we collect, use, share, and protect information in connection with the Care-N-Care Service.

1. Who We Are

My POD Care Inc (“Care-N-Care,” “we,” “us,” or “our”) operates a calendar and communications platform that helps neighbors coordinate care. We are the controller of personal information we process in connection with the Service.

2. Scope

This Privacy Policy applies to information we collect about you when you use our website, mobile application, or other services that link to this Policy (collectively, the “Service”).

3. Information We Collect

3.1 Information You Provide

  • Account information: name, email address, phone number, password, neighborhood or general location, emergency contact information (name and phone number), and similar details when you create an account.
  • Profile information: information you choose to share about your household, pets, children (e.g., names or nicknames, ages, profile photos, and Dependent Care Notes such as allergies, medical conditions, dietary restrictions, and care instructions), and any preferences for care.
  • Care & scheduling information: bookings, time slots, group memberships, notes about care sessions or arrangements, and real-time GPS location data shared by caregivers during active care sessions.
  • Communications & content: messages, posts, photos (including photos shared in care blocks during care sessions), and other content you submit to groups or send to other users.

3.2 Information We Collect Automatically

  • Device & log data: IP address, browser type, operating system, device identifiers, pages visited, links clicked, and timestamps.
  • Usage data: interactions with features (such as calendar events created, messages sent), and app performance data.
  • Approximate location: derived from your IP address or general location settings in the app, used to help you connect with local groups.
  • Push notification tokens: device push notification tokens, collected when you grant notification permissions, used solely to deliver care-related alerts and reminders.

3.3 Location Data & Accuracy

The Platform may use location information to provide features such as group coordination and safety-related data display.

Location data may be derived from your device's GPS, IP address, or general location settings. Care-N-Care does not guarantee the accuracy, precision, or timeliness of any location-based information, including:

  • The boundaries or coverage areas of safety data
  • The proximity calculations between your location and points of interest

Location updates are sent only when the caregiver's device detects movement, so a long elapsed time typically indicates the caregiver has been stationary — common during home-based care sessions such as playdates. Updates may also become unavailable due to device battery conditions, iOS background restrictions, or signal loss. Care-N-Care displays the time elapsed since the last location update so users can assess whether the caregiver is stationary or whether tracking may be interrupted.

When you use the Get Directions feature, the address of the scheduled care location is passed to the navigation application you select (such as Apple Maps, Google Maps, or Waze, or similar navigation applications). This transfer is initiated by you and governed by the selected application's own privacy policy. Care-N-Care does not receive data from or have control over third-party navigation applications.

Location-based features are provided as informational tools only and should not be relied upon as precise or comprehensive safety assessments. You are responsible for independently verifying any location-based information that may affect decisions about safety or care.

In addition to accuracy limitations, location sharing may be interrupted or unavailable due to factors outside of Care-N-Care's control. These include, without limitation: device battery depletion; the app being force-quit or suspended by the operating system; OS-level background location restrictions; loss of GPS, cellular, or Wi-Fi connectivity; airplane mode; or the caregiver disabling location services on their device. Care-N-Care does not guarantee continuous or uninterrupted location data during care sessions. Gaps or interruptions in location sharing are not a breach of this Policy and do not give rise to any claim against Care-N-Care.

Location Sharing During Active Care Sessions

When a care session is active (for example, when a caregiver is watching a child on behalf of another parent), the Platform may collect and share real-time GPS location data from the caregiver's device with the parent(s) whose child is being cared for.

How it works:

  • Location sharing is active only during an active care session and is automatically deactivated when the session ends
  • Location data is shared only with the parent(s) or guardian(s) whose child is involved in the active care session — it is not visible to other group members, the public, or any third party
  • Location sharing ends when the receiving parent (the parent whose child is being cared for) confirms pickup, completing the reverse handoff that mirrors the drop-off action that started the block. The care-providing caregiver may signal that care is complete (triggering a pickup request to the receiving parent), but this is a request — not a termination. GPS sharing does not stop until the receiving parent confirms the pickup.
  • Location sharing requires the caregiver's device to have location services enabled; the caregiver may disable location services through their device settings at any time
  • As a safety measure, if a care session has been active for more than 12 hours past its scheduled end time without a pickup or drop-off confirmation, the Platform will automatically stop GPS sharing for that session. Both the caregiver and receiving parent will receive a push notification when this occurs. The auto-end event and its timestamp are logged for safety and audit purposes. This automatic termination does not delete any previously collected location data — retention of that data continues to be governed by the data retention provisions described below.

Care session participant visibility:

  • When a parent posts a care request within a group, all members of that group can see the request itself. Once a group member accepts and becomes a participant in that care block, only the accepting participants can see the scheduled block details (date, time, location, and which children/pets are participating). Non-accepting members of the group never see the scheduled block details — only the original request. If a care block is rescheduled, the rescheduled details are visible only to participants who accept the reschedule.

What we collect:

  • GPS coordinates from the caregiver's device during the active care session
  • Timestamps associated with location updates
  • Session start and end times
  • Participant information (which parents and children are part of a care session)

What we do NOT do:

  • We do not track location outside of active care sessions
  • We do not store historical location trails or movement patterns beyond what is necessary for the active session
  • We do not share caregiver location data with advertisers, data brokers, or any third party
  • We do not track children's devices — location tracking applies only to the caregiver's device during an active session

Caregiver controls:

  • Caregivers can signal that care is complete (e.g., that the child is ready for pickup) through the in-app control. This notifies the receiving parent but does not immediately stop location sharing — sharing ends when the receiving parent confirms pickup.
  • Caregivers can review their location sharing status at any time within the app
  • Caregivers provide consent to location sharing during the group membership onboarding flow. This consent covers all care sessions within that group where location sharing is enabled

Location data collected during care sessions is considered sensitive data under applicable state privacy laws (including the Connecticut Data Privacy Act). By enabling and participating in care sessions with location sharing, you consent to this collection and sharing as described above.

3.4 Cookies and Similar Technologies

We use cookies and similar technologies to remember your preferences, keep you signed in, understand how the Service is used, and improve our features. You can control or disable cookies through your browser settings, though this may affect certain functionalities.

4. How We Use Your Information

We use the information we collect for purposes including:

  • Providing, maintaining, and improving the Service and its features.
  • Creating and managing your account and group memberships.
  • Facilitating care scheduling, reminders, and communication between members.
  • Sending service-related notifications, such as changes to a booking or updates to our terms.
  • Monitoring and enforcing compliance with our Terms and Community Guidelines.
  • Protecting our users, our platform, and our legal rights (e.g., fraud prevention, security).
  • Enabling real-time location sharing between caregivers and parents during active care sessions, so parents can see where their child is being cared for.
  • Conducting analytics and improving our user experience, using aggregated and/or de-identified information where possible.
  • Complying with legal obligations and responding to lawful requests from authorities.

5. Legal Bases (Where Applicable)

Where laws require us to have a legal basis to process your personal information (for example, in the European Economic Area or the UK), we rely on one or more of the following bases:

  • Contract: processing necessary to provide the Service you requested.
  • Legitimate interests: such as maintaining and improving the Service, preventing abuse, and protecting users.
  • Consent: for certain uses (e.g., some marketing). You can withdraw consent at any time.
  • Legal obligations: where we must process data to comply with the law.

We may share your information as follows:

  • With other users: information reasonably needed to coordinate within your groups, such as your name, profile details, and content you choose to share. During care sessions (such as playdates or care blocks), participating parents within the same private group can see which children are participating. Caregiver GPS location during active sessions is shared only with the parent(s) whose child is being cared for.
  • With service providers: third parties who help us operate the Service (for example, hosting, analytics, communications, or payment providers). They are only allowed to use your data to provide services to us and must protect it appropriately.
  • For legal reasons: when we believe in good faith that disclosure is necessary to comply with the law or legal process, protect the rights and safety of our users or the public, or to enforce our Terms.
  • Business transfers: as part of a merger, acquisition, financing, or sale of all or part of our business, subject to appropriate confidentiality protections and continued protection of your data.

We do not sell your personal information to third parties for their own independent marketing purposes.

All service providers are contractually required to protect your data and use it only for the purposes described above. We do not permit service providers to use your personal information for their own marketing purposes.

7. Advertising, Analytics & Third-Party Tracking

Current Practices

Care-N-Care does not currently:

  • Display third-party advertisements within the Platform
  • Share personal information with advertising networks or data brokers
  • Use third-party tracking pixels or advertising SDKs
  • Sell or share personal information for targeted advertising purposes

Analytics

We may use analytics tools to understand how the Platform is used and to improve our features. Analytics data is collected in aggregated or de-identified form where possible. Any analytics service providers we use are bound by contractual obligations to protect your data and use it only for the purposes of providing analytics services to us.

Future Changes

If we introduce advertising, third-party tracking, or new analytics tools in the future, we will update this Privacy Policy before doing so, provide appropriate notice, and offer opt-out mechanisms as required by applicable law.

8. Data Retention

We retain personal information for as long as reasonably necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention practices include:

  • Account data: Retained for the duration of your active account, plus a reasonable period after account deletion to comply with legal obligations (generally up to 30 days for technical deletion, and up to 1 year for legal/compliance records)
  • Care session location data: Real-time GPS data shared during active care sessions is retained only for the duration of the session and a short period afterward (generally up to 7 days) for dispute resolution and safety purposes, then automatically deleted
  • Terms acceptance records: Retained indefinitely as legal proof of consent
  • Usage and analytics data: Retained in aggregated or de-identified form; identifiable usage data is retained for up to 12 months
  • Communications and content: Retained for the duration of your account; group messages are retained as long as the group is active

When information is no longer needed for the purposes described above, we will delete or anonymize it. You may request deletion of your personal information at any time by contacting us at privacy@care-n-care.com, subject to legal and operational exceptions.

Depending on your location and applicable law, you may have rights to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate or incomplete information.
  • Request deletion of your personal information, subject to legal and operational exceptions.

  • Delete your personal information, subject to certain exceptions

How to Exercise Your Rights

You may exercise your privacy rights by contacting us at privacy@care-n-care.com. We will respond to verifiable requests within the timeframes required by applicable law (generally 45 days, with possible extensions as permitted by law).

To protect your privacy and security, we will take reasonable steps to verify your identity before fulfilling your request. If we are unable to verify your identity, we may ask for additional information.

Appeal Process

If we deny your privacy request, you have the right to appeal our decision. To submit an appeal, contact us at privacy@care-n-care.com with the subject line “Privacy Request Appeal.” We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may contact the Connecticut Attorney General's office at https://portal.ct.gov/AG.

Sale of Personal Information

Care-N-Care does not sell your personal information to third parties. We do not share your personal information with third parties for purposes of targeted advertising. We do not share your personal information with data brokers.

If our data practices change in the future, we will update this Privacy Policy and provide appropriate notice and opt-out mechanisms as required by law.

Sensitive Data

Under certain state privacy laws, some categories of personal information are considered “sensitive” and require explicit consent before processing. For Care-N-Care, sensitive data may include:

  • Children's personal information (names or nicknames, profile photos, and Dependent Care Notes such as allergies, medical conditions, and care instructions, collected through care coordination features)
  • Health-related information (allergies, medical conditions, dietary restrictions, and other health-related details voluntarily provided by parents or guardians in Dependent Care Notes for children and pets — including veterinary information for pets)
  • Precise geolocation data (used for real-time location sharing during active care sessions)

We process sensitive data only with your consent, which you provide during account registration and during the group membership onboarding flow. You may withdraw consent for the processing of sensitive data at any time by contacting us at privacy@care-n-care.com or adjusting your settings within the app. Withdrawing consent may affect your ability to use certain features of the Platform.

11. Children's Privacy & COPPA Compliance

The Service is intended for use by adults (18+).

We do not knowingly collect personal information directly from children under 13. Information about children (such as names, photos, Dependent Care Notes, and care-related details) is collected only through the parent or guardian's account and with their consent, in compliance with the Children's Online Privacy Protection Act (COPPA).

Parents and guardians have the right to:

  • Review personal information collected about their child
  • Request deletion of their child's information
  • Withdraw consent for further collection

If you believe we have collected personal information from a child under 13 without appropriate parental consent, please contact us immediately at privacy@care-n-care.com so we can take appropriate action.

Data Collected About Children

Information about children is collected only through and under the control of a parent or guardian's account. The types of data we may collect about children include:

Profile data (provided by the parent or guardian):

  • Name or nickname, age, and profile notes
  • Profile photo (uploaded by the parent or guardian)
  • Care notes, which may include allergies, medical conditions, dietary restrictions, behavioral notes, emergency instructions, and other information the parent or guardian chooses to provide to help caregivers and group members coordinate safe care for children and pets (“Dependent Care Notes”)

Important note about Dependent Care Notes: Care Notes for children and pets may contain health-related information such as allergies, medical conditions, and veterinary or dietary information. This information is considered sensitive data under applicable state privacy laws. You control what information you include in Care Notes — we recommend including only information that is necessary for safe care coordination. Care Notes are visible to members of your private group(s) and to caregivers during active sessions. They are not used for any purpose beyond care coordination, are not shared with advertisers or data brokers, and are not used for profiling or automated decision-making.

Care session content (shared by parents and caregivers within groups):

  • Photos and updates posted to care blocks by parents, guardians, or authorized caregivers during care sessions
  • These photos are visible only to members of the private group associated with the care session

We limit the collection of children's data to what is reasonably necessary to provide the features described above.

We do not collect the following directly from children:

  • Precise geolocation data (location tracking during care sessions applies to the caregiver's device only, never to a child's device)
  • Social media identifiers or contacts
  • Advertising identifiers
  • Audio or video recordings (other than photos uploaded by parents/caregivers as described above)

Children's data is stored within the parent or guardian's account. Children's data is never sold, shared for advertising purposes, or used for profiling. Photos shared within care blocks are visible only to group members and are not used for any purpose beyond the care coordination features of the Platform.

Information visible to other parents in your group:

When your child participates in a care session (such as a playdate or care block), other participating parents within the same private group can see your child's name (or nickname), participation status, and Dependent Care Notes (such as allergies and care instructions) that you have added to your child's profile. This information is shared so that caregivers can provide safe and informed care. Other parents in your group cannot see any other profile details beyond what you have chosen to share within the group. If you do not want specific health information visible to group members, do not include it in your child's Care Notes.

Parental Controls

Parents and guardians can:

  • View all data collected about their child through their account dashboard
  • Add, edit, or remove Dependent Care Notes (allergies, medical conditions, care instructions) at any time
  • Control what photos are shared in care blocks and with which groups
  • Request a complete export of their child's data by contacting privacy@care-n-care.com
  • Delete their child's profile and associated content at any time
  • Restrict or disable specific features for their child's account
  • Remove photos from care blocks at any time

12. Security

We use reasonable technical and organizational measures to protect personal information from unauthorized access, use, alteration, or destruction. However, no system can be completely secure; you use the Service at your own risk, and you should take steps to keep your account credentials safe.

13. Data Breach Notification

In the event of a data breach that compromises the security of your personal information, we will notify affected users and applicable regulatory authorities in accordance with Connecticut law and other applicable state and federal laws. Notification will be provided within the timeframes required by law (generally within 60 days of discovering the breach) and will include:

  • A description of the incident
  • The types of personal information involved
  • Steps we are taking to address the breach
  • Recommended steps you can take to protect yourself
  • Contact information for questions

These Guidelines explain how we expect members to behave on Care-N-Care. They are part of our Terms and help keep neighborhood care coordination safe, respectful, and useful.

1. Purpose of Care-N-Care

Care-N-Care exists to help neighbors coordinate care and support one another — for children, pets, and households. Everything you post should support this purpose.

2. Real Identity & Authenticity

  • Use your real name and accurate information in your profile.
  • Do not impersonate anyone or misrepresent your relationship to a child, pet, or household.

3. Safety & Respect

  • Communicate respectfully. Harassment, bullying, and threats are not allowed.
  • Do not post hateful or discriminatory content targeting individuals or groups.
  • Do not share content that glorifies self-harm, violence, or dangerous behavior.

4. Care-Specific Guidelines

  • Do not post photos or videos of children you do not have permission to share.
  • Respect the privacy of families, homes, and locations; do not share sensitive personal details publicly.
  • Follow all laws and best practices for child and pet safety during care arrangements.

5. Prohibited Content & Activity

  • Illegal goods or services, including drugs or weapons.
  • Fraudulent schemes, scams, or deceptive offers.
  • Spam, irrelevant self-promotion, or repetitive posting.
  • Sharing private information about others without consent ("doxxing").
  • Any content involving exploitation or abuse of children or vulnerable individuals.

6. Reporting & Enforcement

We encourage users to report content or behavior that may violate these Guidelines. We may take actions such as:

  • Issuing warnings or education to the member.
  • Removing or editing content that violates our policies.
  • Temporarily or permanently suspending accounts or access to features.
  • Notifying law enforcement if we believe there is a risk of harm or illegal activity.

We reserve the right to enforce these Guidelines in our discretion and consistent with our Terms and applicable law.

We may update these Community Guidelines over time. We will indicate when they were last updated and may provide additional notice if changes are significant. Your continued use of the Service means you agree to the updated Guidelines.
